Acceptance of these terms

These Terms of Use govern your access to and use of the Upstate Medicare website. By using the website, you agree to these terms. If you do not agree, please do not use the website. We may update these terms from time to time by posting a revised version with a new effective date.

Educational information—not individualized advice

Website content is provided for general educational purposes. It is not individualized insurance, legal, tax, financial, or medical advice and does not replace the official plan documents, Medicare publications, or advice from a qualified professional who has reviewed your circumstances.

Coverage, premiums, cost sharing, provider networks, formularies, eligibility rules, enrollment periods, and plan availability can vary by plan and service area and can change from year to year. Always confirm the current details before making a coverage decision.

No government affiliation

Upstate Medicare is a non-government agency. We are not connected with or endorsed by the U.S. government, the federal Medicare program, the Centers for Medicare & Medicaid Services (CMS), or the Social Security Administration.

Plans we represent

We do not offer every plan available in your area. Currently we represent 7 organizations which offer 121 products in your area. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options.

No guarantee of enrollment or coverage

Submitting a form, scheduling a conversation, or speaking with an insurance producer does not enroll you in a plan and does not guarantee eligibility, acceptance, coverage, provider participation, prescription coverage, or any particular benefit or cost. An enrollment is effective only after the applicable carrier and Medicare complete their required review and confirmation.

If information on this website differs from an applicable Evidence of Coverage, Summary of Benefits, policy, contract, carrier notice, or Medicare rule, the official document or rule controls.

Appropriate use of the website

You may use this website only for lawful purposes. You may not interfere with the website, attempt to gain unauthorized access, submit false or malicious information, introduce harmful code, scrape personal information, or use the website in a way that violates another person's rights.

Do not submit Social Security numbers, Medicare ID or MBI numbers, banking or payment information, policy or account numbers, detailed medical records, or detailed medication information through general website forms.

Intellectual property

The Upstate Medicare name, logos, original text, graphics, photographs, videos, layouts, and other original website materials are owned by or licensed to UNY Financial LLC, d/b/a Upstate Medicare and are protected by applicable intellectual-property laws. You may view and print reasonable portions for personal, noncommercial use, but you may not reproduce, distribute, modify, sell, or commercially exploit them without written permission.

Third-party websites and services

The website may link to Medicare.gov, carrier websites, scheduling tools, email providers, or other third-party resources. Those services are controlled by their respective owners. A link is provided for convenience and does not make us responsible for the third party's content, availability, security, privacy practices, or terms.

Website availability and warranties

We work to keep the website accurate and available, but information can become outdated and technical interruptions can occur. To the fullest extent permitted by law, the website is provided on an “as is” and “as available” basis without warranties of uninterrupted access, error-free operation, or fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, UNY Financial LLC, d/b/a Upstate Medicare, and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of—or inability to use—this website. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute relating solely to use of this website will be handled in a court with proper jurisdiction in New York, unless applicable law requires otherwise.
